The protection of a citizen’s right to family life within the framework of the
European Union depends both on the recognition of the freedoms of movement and
residence of the members of the family (children, spouse...), and on the legal ties
formalised in their countries of origin. In past decades, both the Court of Justice of the
European Union and the European Court of Human Rights have given an open and
evolving interpretation of the concept of family in their caselaw. By doing so, they
have contributed to overcome existing obstacles to the full protection of a new and
pluralistic family order. Accordingly, European citizens can move within the
European Union with their families, despite in the heterogeneity of family laws of the
Member States. The present article reflects on the creation of a “common European
standard” with regard to the protection of family life for Union citizens.

<summary type="text">La protezione dei minori stranieri non accompagnati nella giurisprudenza europea: quale possibile influenza sulle proposte contenute nel nuovo Patto sulla migrazione e l’asilo?

In the absence of a comprehensive international framework for the
protection of unaccompanied minors, the ECtHR jurisprudence played a
fundamental role in exercising a strong influence on the EU legislation on
international protection, as amended since 2011. More recently, alongside the
Strasbourg judges’ contribution, the EU Court of Justice delivered some important
judgments, originating from preliminary rulings, which clarified the interpretation
of the rules applicable to unaccompanied minors. This article, after analysing the
influence of the jurisprudence on the first reform of the Common European Asylum
System, aims to focus on the most recent interventions of the European Courts in
order to assess their impact on the reform that started with the presentation by the
Commission of the New Pact on Asylum and Migration.

<summary type="text">Il progressivo rafforzamento dello “status di nonno” nel sistema di tutela europeo e nazionale

This article concerns the progressive strengthening of the “status” of
grandparent in the European and national system. In this regard, the European Court of
Justice has interpreted the concept of “visiting rights” (Article 1(2)(a) and Article 2(10)
of Council Regulation (EC) No. 2201/2003) as encompassing also the visiting rights
grandparents in respect of their grandchildren; the European Court of Human Rights has
held that the ties between grandparents and grandchildren are family ties for the
purposes of Article 8 of the Convention and, finally, also the Italian Legislator and
judges have gradually recognized to the grandparents a legally relevant position in
accordance with the international trend.
