My thesis is based on the philosophical-scientific notion of "epistemic complexity" and how that has been "incorporated" in the contemporary environmental law that has already an "interdisciplinary" nature, since on the border between law, science, ethics and economics. It constitutes the "scene" where the need of reweaving the idea of development, unlimited growth and progress manifests both at national and international level through a reorientation of the objectives and the economical political strategies of the last forty years . A key element of this "legal branch" is represented by the precautionary principle (expressly recognized as "mandatory" by the international community since 1992 in the Rio de Janeiro Declaration), which provides a general "duty to act" for the protection of the environment, even if there is no absolute certainty of the risk of serious and irreparable damage. Therefore, several responsibilities arise from both the political decision makers and in the scientific and economic world relatively to the possible risks that a particular "community" could face, accepting the relative consequences. For this reason even not "sectorial" mind-sets appear gradually at substantial legal level of the natural environment, as well as a conception of "strong" environmental sustainability (and "ecological modernization"), not limited to a mere "technical adjustment", nor to precautionary action on an economic cost-benefit analysis of environmental protection; procedurally new "forms" and "spaces" of deliberative "reflexive" democracy (i.e. not simply "pragmatic" ones) are created where rights to information, participation, access to the courts can be practiced more broadly beyond individual preferences of people, not only towards an "individualistic" or "communitarian" perception, but also towards an "ecological" one (inter-relationships between parts and the whole, where the whole has not to be interpreted as the mere sum of the parts). Forms and spaces of an "ecological democracy" which find again in the state, and particularly in a not "interventionist" and not "competitive" state, not enslaved to the logic of competition, market and "financial thinking", their starting point and contemporaneously their "development". At the same time they should and could turn even the state itself into a continuous "process", within "deliberative systems" (on a "transnational" scale), focused on "anthropo-decentralized" ethics. The experiences of Andes neo-constitutionalism (Ecuador and Bolivia cases particularly) finally mark the transition to a new "state based" paradigm oriented to the concept of "multinationality" where "Western" and "indigenous" ideas of “Nature” are harmonized, encouraging to enrich in this way the "systemic" framework for a possible transnational "ecological democracy" towards new ways of considering law, economy, welfare and happiness, different from the material accumulation or simply from the mere "personal life plan"; in other terms towards a new "common sense" and a new "right" to an alternative form of individual and collective life. Il progetto di ricerca analizza alcuni aspetti della democrazia rappresentativa nel XXI secolo, e in particolare i fenomeni quali la democrazia del “pubblico” e la controdemocrazia.
Vengono evidenziati gli effetti delle “promesse democratiche non mantenute” dai soggetti politici, e le cause economiche e sociali che hanno contribuito a destabilizzare la democrazia rappresentativa sia a livello nazionale che europeo (tanto da essere configurata come postedmocratica).
Democrazia del “pubblico” intesa come trasformazione del popolo in “pubblico” non solo per l’influenza di un leader e dell’uso mediatico del suo partito, ma per l’effetto della politica neoliberale di cui i media sono espressione e strumento.
Si segnala come la questione non sia quella di recuperare il metodo del sorteggio come pensa B. Manin, bensì di provare a dare forma a nuovi soggetti politici.
Nell’ultima parte della ricerca vengono analizzati i poteri contro democratici (così come definiti da Pierre Rosanvallon), e le possibili strategie per arginarli.
Le forme del controllo (sorveglianza, sanzione-interdizione e giudizio, secondo la fenomenologia elaborata da Rosanvallon) vengono da noi considerate non tanto espressione di una partecipazione attiva dei cittadini (come vuole Rosanvallon stesso), quanto piuttosto un mezzo per constatare le inefficienze della politica “negativa”.
Il moltiplicarsi, infatti, del lavoro delle autorità indipendenti così come di internet e della stampa ( a partire dagli anni ’90) corrisponde al mal funzionamento dei partiti politici, e il loro compito non può essere accollato a tali istanze, giacché esse hanno funzione di controllo sul mercato ma non di regolazione nella sfera politica.
La nostra riflessione evidenzia come la soluzione non sia nella limitazione dei soggetti politici bensì in una loro nuova costruzione, poiché solo attraverso di essi sarà possibile affermare i diritti della pluralità e sfidare questioni importanti (come il populismo e le tendenze alle individualizzazione estrema del corpo sociale) .
La nostra analisi si sofferma sull’importanza non solo della sfera sociale (come indica Rosanvallon) ma di quella politica, in quanto entrambe risultano necessarie in un contesto che possa dirsi democratico.
Il populismo viene da noi inteso non solo in una veste patologica, cioè come la capacità dell’anti politica di estremizzare la sorveglianza e i poteri di interdizione e di giudizio in un’azione impolitica e contro-politica ( come pensa Rosanvallon), o solo in chiave democratica-radicale, (come ritiene E. Laclau) ossia come costruzione della politica e del politico, bensì in una forma più

articolata perché sintomo della democrazia “economica” (cioè del lavoro delle lobby e della finanza).
La tesi vuole dimostrare come Rosanvallon individui solo alcuni effetti relativi al populismo quale il bisogno di trasparenza nei confronti della politica che ha esasperato il suo elettorato, trascurandone però lo svuotamento dei contenuti politici e la sostituzione degli stessi con forme sociali che provano a nascondere il bisogno della rappresentanza politica attraverso la sua stessa negazione, e come la politica rischi perciò di ridursi ad un contenitore del populismo.
La contro-politica ( o impolitica) viene da noi intesa come fenomeno più ampio, quale: la crisi del potere democratico e dei soggetti collettivi, che denunciano una carenza della politica e del politico.
La nostra proposta illustra la necessità di ripensare ad entrambi in una veste agonista e non antagonista, così come suggerisce la filosofa C. Mouffe.
Il politico infatti, viene da noi inteso non solo come espressione di un concetto storico ( come vuole Rosanvallon) ma anche egemonico ( come ritiene Mouffe).
Inoltre, la “singolarità” viene da noi considerata come l’incapacità delle istituzioni di farsi espressione delle richieste dei singoli, ossia come la mancanza di un’autorità politica in grado di far convergere le richieste della pluralità in un progetto politico; e come ciò abbia portato i singoli a sganciarsi dalla politica e a ricercare nelle proprie capacità (come nel merito e nella fortuna), il modo attraverso cui emergere.
La nostra ricerca da un lato prende atto dell’importanza delle proposte quali comunalità, riflessività, similarità ( messe in campo da Rosanvallon) dall’altro ritiene che esse non possano funzionare se non supportate da un contesto politico adeguato.
La possibilità di una condivisione mediatica (ossia una democrazia orizzontale, che sfocia nel racconto dei singoli) viene da noi ritenuta efficace solo in parte, poiché tale proposta seppur ambiziosa non sarà forse in grado di affrontare le questioni neoliberali, e probabilmente sarà capace solo di far aumentare la fuoriuscita dei suoi sintomi quali: populismo, singolarità e controllo.
Quest’ultimi infatti, rispecchiano il deficit rappresentativo della fase contemporanea, ossia il risultato della mancanza di un’autorità politica (soprattutto di sinistra) in grado di far convergere le richieste della pluralità in un progetto politico.
In chiusura d’analisi, l’ipotesi auspicabile consisterebbe in una nuova politicizzazione dal basso con nuovi soggetti politici, e una cultura politica che sia in grado di comprendere non solo i mezzi propri dell’era mediatica globale ma soprattutto le soggettività popolari, la partecipazione e un potere democratico quale espressione di un contesto normativo e istituzionale. This research wants to focalize its attention on the finance world, especially on the financial markets supervision in order to obtain their simplification and rationalisation. After the computer revolution, the world began a “global village” and most part of the economy has suffered a financialisation process; the decrese and the speed up of the economic exchanges in the space and time found its best expression in the speeding up of the financial exchanges. The current interexchanges have made the financial world more complex and in few years it took over politics. Particularly the categories, by which one used to study politics and States life, have no value anymore: the triad territory – state – nation has to be substituted by a sort of local, national, overnational and international interconnected networks. The crisis of the State moved the balance from the executive to the administrative and the legal certanty with the State monopoly has left the place to an interexchangeable sets of rules network. From here the independent authorities are born and they were succesful even thanks tothe process of liberalization-privatization of the economy. Above all in Italy these Authorities were born in a chaotic and no organic way, with a series of overlaps of competences that don’t let understand “who does what”: so it needs simplification and rationalisation. In the financial world, especially all after the crisis in 2007/2008, we understood that the world, as de Larosière report says, was in front of two ways: or to do chacun pour soi or to take again the destiny in its hands, i.e. to try to take back finance under the direction of politics. the UE chose the second hypothesis leaving Lamfalussy care (soft law) and moving to de Larosière care (hard law), as a doctor does towards ills people: he tries to prevent instead of caring. The European regulations in 2010 and the international institutions like G20, FSB, Basel Committee, IOSCO, IFAC, IASB and IAIS, by their standards, tried to put order again in the financial world and to prevent the socalled “systemic risks” (macroprudential supervision), including the microprudential supervision in the most important sectors of finance (banking, insurance, securities) too. So it is necessary to study and know better the international supervision sistems (coordinated inter se) especially the EU Authorities (EBA, ESMA, EIOPA). The UE needed to rationalise the sistem and imposed it by regulations on every member State; in other words the Bank of Italy, CONSOB, IVASS and COVIP (financial indipendent Authorities) began the longa manus of the European Authorities by introducing into the italian system some rules coming directly from Europe, without “passing” through government or parliament way. Considering that the other member States have more less adeguated their “organogram” of Authorities following the UE model, Italy is still late, no because it didn’t adopte the European binding rules, but because it persevered to retain a “set” of inadeguated Authorities for the financial markets challenge. There are a lot of overlaps – interferences of competences between CONSOB and the Bank of Italy, the Bank of Italy and AGCM, whithout considering the “financialisation” of the insurance sector; Germany faced questions like Bankassurance and Allfinanz by BaFin reform, Italy instead persists in a “mixed” model of supervision in which coexists the “pourpose” model (fixed by TUF) and the “sectorial” model (there are specific supervision Authorities in every sector). In the italian system, as Kant says, it is necessery a new criterion of truth that combines empiricism of the American approach (SEC and CFTC) with the organic system and the predictability of the European model. So it is strongly necessary a simplification – reduction of Authorities to two: one in the field of micropudential supervision (Bank of Italy – CONSOB) and one Authority for macroprudential supervision (like UE model); in this way we’ll have a regulation, with overnational legal standards, based on prefixed, general, abstract defined criterions that are possibly “waterproof” for private interests of strong big groups. This study examines the equalisation as an alternative planning method to the
zoning, and at the same time as a strategic objective for the public administration.
In the absence of a legislative framework, either national or regional, there is not a
reference model for equalisation which it is, thus, subject to plural and flexible
interpretations. In this context, the praetorian law substitutes the legislator, and
legitimizing municipal techniques and plans.
The equalisation technique is not free from the discretionary power of the
municipality, in accordance with territorial, functional and legislative autonomy.
The research aims to identify which are the limits and the evaluation and operating
parameters of territorial planning, particularly in relation to the result to be achieved:
the substantial equality between the owners, allowing a balanced development of the
city services. Preliminary objective is to allocate the rules regulating equalisation in
the right normative sources.
The legal vacuum is eroded from the "bottom" by the joint public-private exercise of
planning in a view of power contractualisation. It is the local public administration
which should bind itself, preparing its "own" rules. Detected the functional and
hierarchical inadequacy of the rules contained in local urban planning, it is the
municipal statute, as sub-prime legislative source, within its competences, which can
ensure the required warranties to private property, through the provision of upstream
rules , which contain technical, economic and quality standards to be applied to the
municipal equalisation method.
The proposed legal framework has a double effect, on one hand, it creates a planning
method with stable rules, on the other, it provides more guarantees to the private
sector in the "vertical" relationship with he local authority, owner of conformative
