In the numerous EU law writings dealing with the integration of immigrants, the
doctrine has focused on the principle that this must fundamentally tend to foster the gradual
assimilation of immigrants into the social and economic fabric of the host country. In
particular, the adoption of discriminatory policies against immigrants should be avoided as a
matter of principle. Contrary to this mainstream view, according to which EU law ultimately
considers cultural diversity as a barrier to be eliminated, the present study aims at pointing
out that, at a European level, cultural diversity is a value that, albeit with certain particular
limitations, has to be preserved and consolidated in order to promote a constructive dialogue
between immigrants and citizens of the host country.

The article builds on the renewed interest in the circulation of public
documents and authentic instruments in the European judicial area, reflected by the
adoption of Regulation 2016/1191, which simplifies the formalities required for
submitting civil status records of one Member State in all the other Member States,
as well as by the more comprehensive and detailed rules concerning the circulation
and enforceability of authentic instruments in the most recent European acts of
private international law, in particular Regulations 650/2012, 2016/1103 and
2016/1104, and in Regulation 2019/1111, recasting Regulation 2201/2003.

<description>La (olvidada) perspectiva de género en el Derecho internacional privado

The necessity of a gender perspective in Private international law is
observed with emphasis in several aspects of family law and the treatment done in
this regard to the women’s rigths. In particular, this article focuses on several
paradigmatic aspects such as the disparities existing in the Muslim law which
contradict the lex fori and which is the practical function of International public
policy in the aplication of that foreing law. Also paradigmatic and absent of gender
perspective, until now, is relating to the cases of children abduction comitted as a
consequence of a gender violence situation. Very worrying is also the increasment
of gender violence against foreing women in Spain notwithstanding the regulation
protecting them existing in Spain. Lastly, an analysis of the maternity by subrogacy
is done and the forgotten protection of the women rights, in particular that of the
expectant mother and the mother without a genetic link.
