Controllo e misure alternative: la rete di partenariato della giustizia
Abstract
The purpose of the work is to analyze a field not much explored by the Italian social
research: the role of the probation service –so of the Office of External Penal Execution
(UEPE)– within the partnership networks. It is a kind of office introduced in our legal
system after the entry into force of the law 354/75, according to which the penalty applied
should not longer take place inside the prison, but directly in the territory, through the
identification of treatment pathways aimed to the rehabilitation and re-integration of the
convicts, while respecting the principle of individualization of the treatment. It is in this
renewed reading of the penitentiary system that emerges the importance of UEPE, that, as
defined by law 118 DPR 230/00, must be integrated with the local territory through the socalled
networking, in order to carry out the treatment in an external environment, involving
local participants and institutions of Justice.
It is on these bases that empirical research conducted at the UEPE Salerno is developed,
through which it has been possible to analyze the network of partnership created between
2009 and 2014 and the role of UEPE within it. It has also been possible to study the
opinions of people in charge–the director and social workers– about the Italian penitentiary
policies.
In this way it is possible to trace the role of UEPE in the light of the new legislation and
understand how, according to the specialists, the partnership networks created can help for
rehabilitation and reintegration. [edited by Author]
