Il progetto di creazione della Procura europea nello spazio europeo di libertà, sicurezza e giustizia
Abstract
The article 86 TFEU estabilishes that in order to combat crimes affecting the financial interests of the Union, the Council may establish a European Public Prosecutor's Office from Eurojust. To carry out the cited norm, on the wake of the projects of “Corpus Juris” and “Model Rules”, the Commission worked out a proposal for a Council Regulation on the establishment of the European Public Prosecutor's Office (COM/2013/0534 final). On this proposal the Council wasn’t able to obtain the unanimity, anyway 20 Member States decided to establish enhanced cooperation to adopt the Regulation de quo. Waiting for the consent of the European Parliament, we wish that the expectant organ won’t be too much “weak” and that it will be able - even if without a “european criminal law” – to efficiently protect the financial interests of the EU, in the perspective of a full achievement of the european area of freedom, security and justice.
