Abstract: This contribution aims to show how the interpretation of Directive 2003/86&#xD;
on family reunification between third-country nationals is made by the CJEU case-&#xD;
law in the light of the fundamental rights of the EU Charter. On the one hand, the&#xD;
Court recognizes a broad concept of the notion of “family”, not only when it comes&#xD;
to relations between family members, but also to the complex nexus of the legal rights&#xD;
involved. The CJEU asks the referring courts for a case-by-case assessment. As a&#xD;
result of this approach, the concept of effective family life is also interpreted in a&#xD;
broader sense. It requires the intention for family members to see each other and keep&#xD;
in touch rather than live together and provide mutual financial support. On the other&#xD;
hand, the conditions set out by the directive, whose respect is required by the member States to grant the family reunification, are interpreted strictly. As regards the age&#xD;
requirement, the Court states that it corresponds to the time of the application in order&#xD;
to respect the principles of legal certainty and equal treatment. The Court demands&#xD;
an individual assessment regarding the integration in a member State; such a&#xD;
condition is often confronted with contradictory interests or rights (for example&#xD;
family reunification vs the child’s interest). “Economic resources” fall under the&#xD;
exceptions to family reunification, which are interpreted narrowly by the EU Court.&#xD;
Nevertheless, a margin of discretion is granted to the national authorities; the same&#xD;
can be said for exceptions of public order.</summary>

Abstract: La libre circulación de mercancías en la Unión Europea ha sido durante
muchos años el motor de la integración económica europea, pero, además, en
aplicación de las disposiciones del TFUE que la conforman el TJUE ha establecido
principios y conceptos europeos que luego han sido aplicados a otras áreas del
Derecho como el Derecho Internacional Privado. Conceptos como el principio del
mutuo reconocimiento, o las razones imperiosas que pueden limitar las libertades
europeas fueron definidos en la interpretación que el TJUE hizo de esta libertad. Tras
el cumplimiento del trigésimo cumpleaños del mercado interior, esta libertad ha
llegado a un grado de madurez en el que se presenta como “libertad consolidada”; The free movement of goods in the European Union was the driving force
behind European economic integration and, in application of the provisions of the
TFEU that establish it, European principles and concepts were dictated that were later
applied to other areas of law such as private international law. Concepts such as the
principle of mutual recognition, or the overriding reasons that may limit European
freedoms were defined in the CJEU’s interpretation of this freedom. Now that it has
reached its thirtieth birthday, this freedom has reached a stage of maturity where it is
presented as a “consolidated freedom”</summary>

    <title>Violenza digitale e Convenzione di Istanbul: una dimensione distinta ma non separata dalla violenza contro le donne</title>

    <summary type="text">Title: Violenza digitale e Convenzione di Istanbul: una dimensione distinta ma non separata dalla violenza contro le donne

Abstract: La nozione di “violenza contro le donne nella sua dimensione digitale” o
“dimensione digitale della violenza contro le donne” è sufficientemente ampia da
comprendere sia gli atti di violenza online che quelli perpetrati attraverso la
tecnologia, comprese le tecnologie ancora da sviluppare. Questi atti fanno parte del
continuum della violenza offline di genere contro le donne. Pertanto, sebbene la
Convenzione di Istanbul non affronti specificamente la dimensione digitale della
violenza contro le donne e della violenza domestica, è tuttavia rilevante nel prevenire
e combattere questa dimensione distinta ma non separata della violenza contro le
donne, insieme ad altri trattati, come la Convenzione di Budapest; The notion of “violence against women in its digital dimension” or the
“digital dimension of violence against women” is comprehensive enough to comprise
both online acts of violence and those perpetrated through technology, including
technologies yet to be developed. These acts are part of the continuum of offline
gender-based violence against women. Therefore, although the Istanbul Convention
does not specifically address the digital dimension of violence against women and
domestic violence, it is nevertheless relevant in preventing and combating this
“distinct” but not “separate” dimension of violence, together with other treaties, such
as the Budapest Convention</summary>
