Abstract: | In the first part, the paper analyzes the EU legislation on the “European green pass” (Regulation no. 953/2021) in a multi-level perspective, comparing it with the national legislation that introduced an “extended green pass” and looking into the current debate on the legitimacy of the green pass in light of constitutional and supranational provisions (i.e. primarily the principle of proportionality and nondiscrimination) in respect of fundamental rights. The second part deals with the problem of a possible “compulsory vaccination”, which according to some would be hidden behind the provisions of the green pass. |
