L'evoluzione delle relazioni familiari nel contesto interculturale

Abstract

L’affermarsi di una serie di nuovi modelli di famiglia, spesso finalizzati a risolvere alcuni problemi sociali, è già avvenuta in parecchi ordinamenti stranieri, grazie a una metamorfosi della famiglia tradizionale proveniente dalle libere scelte dei componenti. Si è annullato un modello precostituito di famiglia e a esso si è sostituito uno più flessibile e adattabile alle esigenze della società che diventa sempre più multiculturale. La situazione in cui versa l’Italia, attraversata da importanti flussi migratori che determinano una mescolanza tra culture diverse, impone la necessità di gestire una serie di questioni che il nostro ordinamento è tenuto ad affrontare per individuare soluzioni. A questo proposito è determinante ricordare che il pluralismo culturale non ritiene che le culture debbano essere chiuse e distanti fra loro, ma piuttosto, in una prospettiva interculturale, aperte ciascuna alla realtà dell’altra. Il presente lavoro si sofferma sul cambiamento di prospettiva, che coinvolge anche la famiglia e vede quest’ultima ampliarsi e assumere nuove caratteristiche, ma anche subire una sorta di morfogenesi che si manifesta tramite l’indebolimento e la frammentazione dell’istituto e porta con sé enormi squilibri socio-demografici, che richiedono l’intervento dello Stato.

The emergence of a series of new family models, often aimed at solving social problems, has already occurred in several foreign legal systems, thanks to a metamorphosis of the traditional family resulting from the free choices of its members. A pre-established family model has been eliminated and replaced by a more flexible one, adaptable to the needs of an increasingly multicultural society. Italian frame, crisscrossed by significant migratory flows that result in a mingling of diverse cultures, imposes the need to address a series of issues that our legal system must address in order to find solutions. In this regard, it is crucial to remember that cultural pluralism does not believe that cultures should be closed and distant from each other, but rather, from an intercultural perspective, open to each other's reality. This work focuses on the shift in perspective, which also involves the family and sees it expand and take on new characteristics, but also undergo a sort of morphogenesis that manifests itself through the weakening and fragmentation of the institution and brings with it enormous socio-demographic imbalances, which require state intervention.
