| dc.description.abstract | Il presente contributo si prefigge l’obiettivo di analizzare il fenomeno dell’Intelligenza Artificiale applicato all’ambito della giustizia e, più in particolare, al processo civile. Può davvero l’ausilio di un algoritmo affiancare il giudice nella sua decisione o, addirittura, sostituirlo? Alla luce dei pro e contro evidenziati, l’IA potrebbe coadiuvare il giudice senza, però, sostituirlo in toto né in termini formali né sostanziali. Ciò in quanto, punto fermo di ogni ragionamento sulla giustizia predittiva è il principio del giusto processo che dovrebbe suggerire l’adozione di algoritmi che siano in grado di riprodurre autonomamente tutti gli elementi che contribuiscono a rendere un procedimento giudiziario equo e giusto. | dc.description.abstract | This contribution aims to analyze the phenomenon of Artificial Intelligence applied to the field of justice and, more specifically, to civil proceedings. Can the help of an algorithm really support the judge in his decision or even replace him? In light of the pros and cons highlighted, the AI could assist the judge without, however, completely replacing him either in formal or substantial terms. This is because the cornerstone of any reasoning on predictive justice is the principle of due process which should suggest the adoption of algorithms that are capable of autonomously reproducing all the elements that contribute to making a judicial proceeding fair and just. It is, therefore, necessary to maintain a conceptual difference between the human and his empathy and the artificial and his apathy | it_IT |
