fundamentales del menor, la representación legal y el interés superior del menor.; Regulation (EU) 2025/327 on the European Health Data Space (EEDS) is the most farreaching regulatory instrument adopted to date in the field of health data governance in the European Union. In this context, the legal protection of minors presents a unique
challenge that requires harmonizing international, European, and national regulations regarding the ownership of minors fundamental rights, the institution of legal representation, and the best interests of the child.

Authors: Giampieri, Patrizia
Abstract: The huge strides forward made by GenAI has prompted the scientific community to pose compelling questions about its reliability and accuracy, especially in high-stakes
environments such as the legal one. Polysemy is one of the features characterising legal language that, inevitably, gives rise to ambiguity. In light of the ISO 24495-2:2025
standard on plain language and legal communication, there has been an increasing
demand for the easification of the language of the law. In view of the efforts that legal
drafters make to comply with such regulations, this paper wishes to explore the extent to which GenAI can support humans in the identification and disambiguation of polysemy in legal discourse. To this aim, two legal texts of approximately 60-70 words each are focused on. The first one is extracted from the UK House of Lords decisions, whereas the latter is sourced from English online terms of service. Six chatbots are considered for the cases under scrutiny, amongst which two are field-related. The texts are inputted into the chatbot prompt boxes, and the GenAI tools are prompted to pinpoint polysemous words and disambiguate (i.e., explain) them. The findings reveal scattered responses, sometimes inconsistent with one another, and a lack of coherent approaches. Some chatbots label terms with different grammatical functions (e.g., verbs/nouns) as polysemic, whereas others hallucinate. Therefore, the paper indicates that, at the time being, intelligent machines cannot replace humans’ discernment and capacity to identify and disambiguate legal language subtleties.; I progressi compiuti dall'IA generativa (GenAI) hanno incentivato lo studio della sua affidabilità e accuratezza, soprattutto in contesti ad alto rischio come quello legale.

This article systematically analyzes the phenomenon of flight delays and cancellations in air travel, reconstructing the regulatory, case-law, and technical framework governing passenger protection in the European legal system. Starting from an examination of Regulation (EC) No. 261/2004 and the 1999 Montreal Convention, the paper highlights the two-phased nature of the protection system, based on automatic protection—assistance, reimbursement, rerouting, and financial compensation—and personalized compensatory protection, based on proof of additional damages. The analysis delves into the notions of long delay and cancellation, the definition and scope of extraordinary circumstances, as well as the distribution of the burden of proof, in light of the case law of the Court of Justice of the European Union. Finally, the manuscript proposes a reflection on the prospects for reforming Regulation 261/2004, highlighting the need to clarify the most controversial concepts and strengthen the mechanisms for effective passenger protection, in a sector characterised by increasing complexity and economic importance. Therefore, the
so-called European path (disapplication, preliminary ruling) is accompanied by an unprecedented internal path, which, according to the most recent constitutional rulings, must be activated when the issue takes on a “constitutional tone”. Many questions are raised by such a solution, which undoubtedly offers some important
advantages, but which risks undermining the principle of the primacy of EU law, as recognized by many. In this renewed scenario, the national judge is faced with a new challenge, having the difficult task of navigating between various remedies and having to choose the most convenient one in relation to the specific case.

Authors: Sandirocco, Luigi
Abstract: Un'analisi ragionata della complessa metamorfosi storico-giuridica dell'enfiteusi. La transizione dai modelli classici romani dello ius in agro vectigali sino all'assetto contrattuale autonomo e flessibile. A reasoned analysis of the complex historical-legal metamorphosis of emphyteusis. The origins of the institution, tracing the path from Attic law and Hellenistic customs to the regulations found in the Justinianic compilation. The transition from classical Roman models such as ius in agro vectigali to a flexible, autonomous contractual arrangement. This doctrinal independence, formally enshrined in the lex of Zenone, resolved longstanding legal debates that sought to classify the relationship as either a sale or a lease, instead establishing a third contractual path based on written agreements and a precise allocation of risk regarding the loss of the property. It reflects the erosion of the absolute nature of Roman dominium and the recognition of human labor as a commodity of exchange with independent commercial significance.
