Authors: Cherchi, Alice
Abstract: The article compares C. 11.(7)6 and Cod. Th. 10.19 with the aim of highlighting the method and the logics
used by Justinian’s Compilers in reordering the mining legislation coming from the Codex Theodosianus. By
examining the provisions accepted or rejected in the Justinian’s Code, the research shows that the careful
selection and amendment of the laws coming from Cod. Th. 10.19 preformed by the Justinian’s Compilers
took primarily in account the need to remove interpretive doubts in order to better safeguard the specific
interests involved in the mining law.

Abstract: Through the reference to the imperial constitution contained in C. 11.41(40).4, the article
focuses the means of protection and promotion of the imperial image, as a tool of political
propaganda. The prohibition on juxtaposing the image of the princeps to the pictures of ill-reputed people, such as pantomini, agitatores, histriones, affects the evaluation of

Title: Alcune riflessioni sul rapporto tra il carattere popolare dell'azione e la legittimazione attiva
Authors: Giagnorio, Michele
Abstract: The purpose of this article is to reflect on the relation between the
popularity of the actio and an active legitimacy attributed to quivis de
populo(anyone among the people) which, according to jurists in the Severian
Age, seems to be the distinctive feature of every popular action. An analysis
of the main actiones populares introduced by the praetor’s edict reveals that
the circumstances it granted had an evident social relevance. Thus, the popular
nature of the action laid on the attribution to every civis of the right to defend collective interests regardless of his direct involvement. By an actio popularis
any violation to personal interests was punished, provided that this action also
served to protect the public interest. Therefore, the need to punish it justified
an extension of the individuals who could bring such action.
