Title: La Carta sociale europea alla prova della rivendicazione dei diritti sociali da parte dei beneficiari di protezione internazionale con particolare riferimento al diritto alla salute e alla situazione dei rom in Italia
Authors: Cadin, Raffaele; Zambrano, Valentina
Abstract: Il presente contributo, dopo aver delineato l’evoluzione storico-giuridica
vulnerabile eterogeneo: quello dei Rom.; After outlining the historical and legal evolution of the Social Charter
following the 1996 revision, this article focuses on the protection that this system
guarantees to individuals benefiting from any form of international protection,
protection that owes much to the evolving practice of the European Committee of
Social Rights. On the basis of these general aspects, the article then analyses the
right to health and medical care that the aforementioned category of individuals can
be assured on the basis of the Charter. The next part of the work examines the
interesting evolution of the relationship between the Italian legal system and the
European Social Charter in the light of constitutional jurisprudence, with a view to
highlighting the possible repercussions of the Committee’s jurisprudential practice
on the situation in Italy of a particular heterogeneous vulnerable group: the Roma.

Some reflections about due diligence by the State in the protection against gender-based violence in Europe

Title: Some reflections about due diligence by the State in the protection against gender-based violence in Europe
Authors: Martínez García, Elena
Abstract: The international Istanbul multilateral Treaty is a real opportunity to
achieve systemic changes. As the jurisprudence of international judicial bodies
(ECtHR, CEDAW Committee, etc.) has recognised, the transformative power of
judgments must highlight the importance of the gender perspective when legislating,
preventing, protecting and redressing the injustices of the patriarchal system we have
inherited, since States bound by EU law and the Istanbul Convention are required to
remove the obstacles that prevent equality and, if they fail to do so, international
instruments guarantee redress for such obstacles. This is the greatness of Article 29
of the Istanbul Convention: due diligence of States and positive obligations to
transform the position of women in society and, of course, legal remedies for those
cases where a harm was done by the inaction of the State. This is aligned with the
heightened safeguards and due diligence also recognised by Directive (EU)
2024/1385 of the European Parliament and of the Council of 14 May 2024 on
combating violence against women and domestic violence. This study has a
comparative, jurisprudential and dogmatic methodological focus in order to achieve the main objective: to initiate a new period for such a human right for women,
defining specific State obligations.

European Arrest Warrant in (post) pandemic times: challenges and opportunities

Title: European Arrest Warrant in (post) pandemic times: challenges and opportunities
Authors: Pérez de Tudela, Esther Montero; Martín-Ríos, Pilar
Abstract: In 2002, the Council of the European Union adopted Framework Decision
2002/584/JHA on the European Arrest Warrant and the surrender procedures between
Member States. Since then, it has been one of the most widely used instruments of
mutual recognition in the field of legal cooperation in criminal matters at the
European level. Due to the pandemic of 2020, the general paralysis of the justice
systems and the obstacles and difficulties arising from the limitations caused by
COVID-19 also affected procedures under the European Arrest Warrant, which,
given its relevance due to its frequent use, deserves analysis. This paper analyzes the effects that the pandemic has had on procedures related to the European Arrest
Warrant, complementing the conclusions of this study with an analysis of the
challenges faced and the opportunities that arose from them, with the aim of
contributing to an improvement in its use.

(Im)mobility in the context of climate change: between legal challenges and legal experiments

Title: (Im)mobility in the context of climate change: between legal challenges and legal experiments
Authors: Courtoy, Marie; Gatta, Francesco Luigi
Abstract: The article evaluates whether existing legal frameworks can effectively
protect and assist individuals displaced by climate change-related events. It first
analyses the EU legal order, highlighting the absence of a structured and protectionoriented approach to climate-induced migration. It then examines the international
protection regime, focusing on refugee law and human rights law as potential sources
of limited protection, including the analysis of soft law instruments that have
promoted the idea of safe, legal, and organised migration management. Finally, the
article explores recent practical solutions, with particular attention to legal and policy
initiatives in Oceania, which has emerged as a significant laboratory for innovative
responses to climate mobility. By way of conclusion, an assessment of the overall
adequacy of current legal frameworks in addressing climate change–related
displacement will be provided.
