Abstract: Elena Tassi Scandone addresses the legal history of res sanctae and delimits the survey with an analysis in four moments: the testimony of sources and interpretations of historiography; the rite of the sulcus primigenius; the protection of res sanctae; the inviolability of sanctus meant as munitus and then subjected to punishment in case of violation. The researcher focuses on the origin of sanctitas the walls and on the rite of the sulcus primigenius, states that the prohibition of passing the old basis in fas. Those who violate the ban is hostis and commits an act hostile et abominandum. The sanctitas then merges the concept of sanctio. Sanctus become over time quod sine poena violari non potest. Imperial era, finally, the projection is sanctitas sanctio, and also the access doors to the city are sanctae and quodammodo converge in res divini iuris.
