Abstract

The thesis work analyzes how automation, thus the use of artificial intelligence intervenes on the institution of the contract, and in particular on the execution of the agreement . For these reasons, the analysis will focus mainly on algorithms capable of automatically concluding or executing agreements i.e. the so-called smart contracts, typified by the ltalian legislature in Art. 8 ter of Decree Law No. 135 of December 14, 2018, converted into Law No. 12 of Februaru 11, 2019, and defined as "a computer program that operates on technologies based on distributed registers and whose execution automatically binds two or more parties on the basis of effects predefined by them." That being said, given the definition given by our legislature of such an institution in order to understand their legal nature, first of all, it seemed appropriate for the writer to delve into the institution of execution: can a notion of executive activity be outlined? .. Il lavoro di tesi analizza in che modo l'automazione, quindi I’impiego dell'intelligenza artificiale interviene sull'istituto del contratto, ed in particolare sull'esecuzione dell'accordo. Per tali ragioni I'analisi verterà principalmente sugli algoritmi in grado di concludere o eseguire automaticamente accordi ossia i c.dd. smart contracts, tipizzati dal legislatore italiano nell'art. 8 ter del d.l. 14 dicembre 2018, n. 135, convertito nella l. 11 febbraio 2019, n. 12, e definiti come "un programma per elaboratore che opera su tecnologie basate su registri distribuiti e la cui esecuzione vincola automaticamente due o più parti sulla base di effetti predefiniti dalle stesse".
