Ancora sull' "actio civilis in factum". Nuovi spunti ricostruttivi per una antica interpretazione

Abstract

La dottrina romanistica si è interrogata sull’esegesi dei tre passi del Digesto in cui ricorre l’espressione actio civilis in factum e, cioè, i frammenti, D. 19.5.1.1, D. 19.5.1.2 (che vanno letti tenendo conto imprescindibilmente di D. 19.5.1 pr.) e D. 19.5.5.2. L’articolo ripercorre le posizioni degli studiosi che, pur poco inclini ad accettare soluzioni interpolazionistiche, riconoscono, tuttavia, che, nella maggioranza dei casi attestati nelle fonti, l’abbinamento delle due qualifiche civilis ed in factum desta perplessità. In questo senso, si è cercato di valorizzare l’apporto fornito alla soluzione del problema da Manlio Sargenti, soprattutto in un contributo del lontano 2006, sulla scia del quale si tenta di offrire una soluzione originale seppur nell’ambito delle matrici interpolazionistiche.

The doctrine has questioned the exegesis of the three passages of the Digest in which the expression actio civilis in factum occurs and, that is, the fragments, D. 19.5.1.1, D. 19.5.1.2 (which must be read taking essential account of D. 19.5.1 pr.) and D. 19.5.5.2. The article traces the positions of authors who, although not inclined to accept interpolationist solutions, recognize, however, that, in the majority of cases attested in the sources, the combination of the two qualifications civilis and in factum raises perplexity. In this sense we have tried to enhance the contribution provided to the solution of the problem by Manlio Sargenti, especially in a contribution from way back in 2006, in the wake of which we try to offer an original solution albeit within the context of interpolationist matrices.
