Considerazioni sul regime processuale dell'actio funeraria

Abstract

Il saggio analizza la natura di actio in (bonum et) equum concepta dell’actio funeraria, azione diretta al recupero delle spese funerarie. Si perviene alla conclusione che essa potesse aver avuto un’origine assai risalente connessa con la necessità di non lasciare insepolti i corpi. È possibile che l’esigenza alla base di questa azione si sia manifestata in occasione del passaggio alla procedura per formulas, come appare confermato dall’ampiezza dei poteri equitativi rimessi all’organo giudicante che appaiono in qualche modo desumibile dall’edictum de sumptis funerum di cui è conservata traccia in D. 11.7.12.2.

The essay analyzes the nature of actio in (bonum et) equum concepta of the actio funeraria, action aimed at recovering funeral expenses. We come to the conclusion that it may have had a very ancient origin connected with the need not to leave the bodies unburied. It is possible that the need underlying this action arose on the occasion of the transition to the per formulas procedure, as appears confirmed by the breadth of the equitable powers entrusted to the judging body which appear to be in some way deducible from the edictum de sumptis funerum of which traces are preserved in D. 11.7.12.2.
