| Abstract: | Il contributo analizza il rapporto tra le attività di intelligence e la tutela dei diritti fondamentali all’interno di un sistema giuridico multilivello nel contrasto alla
criminalità transnazionale. L’indagine esamina, in particolare, i limiti del modello
repressivo rispetto a un approccio orientato ai diritti umani. A tal fine lo studio muove dall’esame delle norme e della giurisprudenza in ambito internazionale ed europeo in
materia di legittimità delle possibili deroghe ed eccezioni ai diritti umani per esigenze
di sicurezza; successivamente esso illustra le prospettive di riforma dell’architettura
informativa eurounitaria alla luce del Report Niinistö e delle recenti iniziative negoziali relative all’INTCEN, evidenziando il rischio di un deficit di controllo giurisdizionale sovranazionale a danno delle garanzie individuali. This paper analyzes the relationship between intelligence activities and the protection of fundamental rights within a multilevel legal system in the context of countering transnational crime. Specifically, the study examines the limitations of the repressive model in comparison to a human rights-based approach. To this end, the research begins by investigating international and European norms and jurisprudence concerning the legitimacy of potential derogations and exceptions to human rights for security purposes. Subsequently, it illustrates the prospects for reforming the European information architecture in light of the Niinistö Report and recent regulatory initiatives concerning the INTCEN, highlighting the risk of a supranational judicial oversight deficit to the detriment of individual guarantees. |
