| Abstract: | La Convenzione UNESCO per la protezione del patrimonio culturale subacqueo mira ad istituire un regime collettivo che assicuri la conservazione di tale patrimonio nell’interesse dell’umanità. Essa lascia agli Stati parte il potere di garantire il rispetto degli obblighi sostanziali in essa sanciti sulla base delle competenze degli Stati nelle aree marine che ricadono sotto la loro autorità, ma anche nelle aree al di fuori della giurisdizione statale, come il mare e il fondo marino internazionale che, in base al diritto internazionale del mare e, in particolare dell’UNCLOS, sono sottoposti a regimi speciali. Di conseguenza, la gestione del patrimonio culturale subacqueo può essere messa a rischio dall’inefficace applicazione delle norme sostanziali da parte degli Stati. L’Unione europea costituisce il sistema giuridico sovrannazionale più efficace tra quelli finora istituiti. Tuttavia, essa non gode di competenze normative specifiche sul tema della tutela del patrimonio culturale e, in particolare di quello subacqueo. Per questo motivo, la materia è principalmente lasciata all’azione degli Stati membri. Appare necessario
accertare se i titoli in base ai quali gli Stati esercitano la propria giurisdizione in base al diritto internazionale e, di conseguenza, secondo quello dell’Unione europea, siano sufficienti per garantire l’efficace attuazione delle norme sostanziali in materia di tutela del patrimonio culturale subacqueo o, se sia, invece, necessario individuare ulteriori basi giurisdizionali per assicurare il controllo e la sanzione delle condotte illecite che riguardano tale patrimonio. The UNESCO Convention for the Protection of the Underwater Cultural Heritage aims to establish a collective regime to ensure the conservation of such heritage in the interests of humanity. This convention leaves to the States Parties the power to ensure compliance with the substantive obligations established therein, based on the States’ jurisdiction over the respective marine areas, but also in areas beyond State jurisdiction, such as international seas and the deep seabed, which, under the international law of the sea, particularly the UNCLOS, are subject to special regulation. Consequently, the conservation of underwater cultural heritage may be jeopardized by the ineffective application of substantive rules by States. The European Union constitutes one of the most effective existing supranational legal systems. However, it does not have specific normative powers regarding the protection of cultural heritage, and particularly underwater heritage. For this reason, the matter is primarily left to the competences of Member States. It appears necessary to determine whether the grounds on which the jurisdiction of States has been recognised thus far under international law and European Union law, are effective to ensure the implementation of the substantive provisions regarding the protection of underwater cultural heritage, or whether it is necessary to identify additional jurisdictional bases to ensure the prevention and sanction of unlawful conducts affecting such heritage. |
