| Abstract: | Questo contributo esamina il fenomeno del traffico illecito di armi per via marittima nel quadro del diritto internazionale e del diritto dell’Unione europea. L’indagine si propone di analizzare i limiti strutturali del regime giuridico degli spazi marini. A tal fine esso ricostruisce il complesso quadro normativo internazionale ed europeo in materia, fissando i necessari parametri terminologici; successivamente l’analisi indaga i conflitti di giurisdizione e i presupposti operativi in materia di sicurezza marittima per poi soffermarsi sugli strumenti di contrasto al fenomeno nella prassi e nella giurisprudenza, con specifico riguardo al contesto italiano. Lo studio adotta un approccio propositivo avanzando la tesi della qualificazione del traffico illecito di armi via mare quale core crime di rilevanza globale, tale da svincolare l’esercizio della potestà punitiva dai tradizionali parametri di immatricolazione. This paper examines the phenomenon of illicit maritime arms trafficking within the framework of international law and EU law. The study aims to analyse the structural limitations of the legal regime governing maritime spaces. To this end, it reconstructs the complex international and European regulatory framework on the matter, establishing the necessary terminological parameters; subsequently, the analysis investigates conflicts of jurisdiction and the operational prerequisites for maritime security, before focusing on the enforcement mechanisms used to counter the phenomenon in practice and in jurisprudence, with specific regard to the Italian context. Finally, the study adopts a proactive approach, advancing the thesis that illicit maritime arms trafficking should be classified as a core crime of global relevance, thereby untethering the exercise of punitive jurisdiction from traditional parameters of vessel registration. |
