The Court of Cassation, through a reasonable line of reasoning, has ruled that a declaration that the offence has been extinguished by the statute of limitations takes precedence over the exclusion of punishability on the grounds of the particularly minor nature of the offence, as provided for in Article 131-bis of the Criminal Code, since the former, by extinguishing the offence, represents a more favourable outcome for the defendant, whilst the latter leaves the criminal offence unchanged in its historical and legal substance. Indeed, the cases in which punishment is excluded on the grounds of the particularly minor nature of the offence revolve around the existence of a complete offence in all its elements which is not punished due to a ‘choice’ made by the legislator. The grounds for the extinction of the offence extinguish called ‘punishability in the abstract’ because they take effect prior to the final conviction and extinguish the very power of the state to impose the criminal sanction threatened by the law.
