<summary type="text">La Carta sociale europea alla prova della rivendicazione dei diritti sociali da parte dei beneficiari di protezione internazionale con particolare riferimento al diritto alla salute e alla situazione dei rom in Italia

Il presente contributo, dopo aver delineato l’evoluzione storico-giuridica&#13;
della Carta sociale derivante dalla configurazione assunta dopo il 1996, si sofferma&#13;
sulla tutela che tale sistema garantisce agli individui beneficiari di una qualsiasi&#13;
forma di protezione internazionale, tutela che molto deve alla prassi evolutiva del&#13;
Comitato europeo per i diritti sociali. Sulla base di tali aspetti generali, ci si&#13;
sofferma, poi, sul diritto alla salute e all’assistenza medica che la categoria di&#13;
individui appena richiamata può vedersi assicurata sulla base della Carta. La&#13;
successiva parte del lavoro esamina l’interessante evoluzione del rapporto tra&#13;
l’ordinamento italiano e la Carta sociale europea alla luce della giurisprudenza&#13;
costituzionale e ciò nella prospettiva di evidenziare possibili ricadute della prassi giurisprudenziale del Comitato sulla situazione in Italia di un particolare gruppo&#13;
vulnerabile eterogeneo: quello dei Rom.; After outlining the historical and legal evolution of the Social Charter&#13;
following the 1996 revision, this article focuses on the protection that this system&#13;
guarantees to individuals benefiting from any form of international protection,&#13;
protection that owes much to the evolving practice of the European Committee of&#13;
Social Rights. On the basis of these general aspects, the article then analyses the&#13;
right to health and medical care that the aforementioned category of individuals can&#13;
be assured on the basis of the Charter. The next part of the work examines the&#13;
interesting evolution of the relationship between the Italian legal system and the&#13;
European Social Charter in the light of constitutional jurisprudence, with a view to&#13;
highlighting the possible repercussions of the Committee’s jurisprudential practice&#13;
on the situation in Italy of a particular heterogeneous vulnerable group: the Roma.

<summary type="text">Some reflections about due diligence by the State in the protection against gender-based violence in Europe

The international Istanbul multilateral Treaty is a real opportunity to&#13;
achieve systemic changes. As the jurisprudence of international judicial bodies&#13;
(ECtHR, CEDAW Committee, etc.) has recognised, the transformative power of&#13;
judgments must highlight the importance of the gender perspective when legislating,&#13;
preventing, protecting and redressing the injustices of the patriarchal system we have&#13;
inherited, since States bound by EU law and the Istanbul Convention are required to&#13;
remove the obstacles that prevent equality and, if they fail to do so, international&#13;
instruments guarantee redress for such obstacles. This is the greatness of Article 29&#13;
of the Istanbul Convention: due diligence of States and positive obligations to&#13;
transform the position of women in society and, of course, legal remedies for those&#13;
cases where a harm was done by the inaction of the State. This is aligned with the&#13;
heightened safeguards and due diligence also recognised by Directive (EU)&#13;
2024/1385 of the European Parliament and of the Council of 14 May 2024 on&#13;
combating violence against women and domestic violence. This study has a&#13;
comparative, jurisprudential and dogmatic methodological focus in order to achieve the main objective: to initiate a new period for such a human right for women,&#13;
defining specific State obligations.

<summary type="text">European Arrest Warrant in (post) pandemic times: challenges and opportunities

In 2002, the Council of the European Union adopted Framework Decision&#13;
2002/584/JHA on the European Arrest Warrant and the surrender procedures between&#13;
Member States. Since then, it has been one of the most widely used instruments of&#13;
mutual recognition in the field of legal cooperation in criminal matters at the&#13;
European level. Due to the pandemic of 2020, the general paralysis of the justice&#13;
systems and the obstacles and difficulties arising from the limitations caused by&#13;
COVID-19 also affected procedures under the European Arrest Warrant, which,&#13;
given its relevance due to its frequent use, deserves analysis. This paper analyzes the effects that the pandemic has had on procedures related to the European Arrest&#13;
Warrant, complementing the conclusions of this study with an analysis of the&#13;
challenges faced and the opportunities that arose from them, with the aim of&#13;
contributing to an improvement in its use.

<summary type="text">(Im)mobility in the context of climate change: between legal challenges and legal experiments

The article evaluates whether existing legal frameworks can effectively&#13;
protect and assist individuals displaced by climate change-related events. It first&#13;
analyses the EU legal order, highlighting the absence of a structured and protectionoriented approach to climate-induced migration. It then examines the international&#13;
protection regime, focusing on refugee law and human rights law as potential sources&#13;
of limited protection, including the analysis of soft law instruments that have&#13;
promoted the idea of safe, legal, and organised migration management. Finally, the&#13;
article explores recent practical solutions, with particular attention to legal and policy&#13;
initiatives in Oceania, which has emerged as a significant laboratory for innovative&#13;
responses to climate mobility. By way of conclusion, an assessment of the overall&#13;
adequacy of current legal frameworks in addressing climate change–related&#13;
displacement will be provided.
