dc.description.abstractThe troubled history of article 19 of Law 7th August 1990, n. 241 provides the undisputable proof of how impossible is to shape the relationship between Public Administration and Private Sector merely relying on the opposition between authority and freedom and on the required and fundamental supremacy of the former over the latter due to the sacrifice of the private interests over the common and general interest. The transformation of the relationship between public administration and Private Sector has involved the meaningful shift of the administrative function from an "active" power (commanding) to a power of control (ruling first and monitoring after) of the citizen's actions, whose statements are directly linked with administrative effects without the strict need for an official formal act from the Public.
