Hacia una sociedad más inclusiva en Colombia: el papel de los animales de apoyo emocional en entornos laborales y universitarios, caso Sentencia T-236/24

Abstract

Este artículo analiza la inclusión de los animales de apoyo emocional en entornos educativos como universidades y entornos laborales, gracias a la Sentencia T-236/24 (Corte Suprema de Justicia, 2024) y la reforma laboral en trámite en el Congreso de Colombia. Se puede decir que estos instrumentos legislativo y jurisprudencial constituyen un avance significativo no solo en permitir el acceso de animales de compañía a otros espacios, sino que resalta la importancia de incluir a las que presentan problemas de salud mental de manera efectiva respetando su derecho a la educación, como debe garantizarse en el caso colombiano. Aún persisten desafíos en cuanto a una adecuada implementación efectiva de estas disposiciones, pero, sin duda, es un paso para tener una sociedad mejor, más justa y más equitativa.

This article analyzes the inclusion of emotional support animals in workplaces and educational settings such as universities, facilitated by Ruling T-236/24 (Supreme Court of Justice, 2024) and the labor reform currently under discussion in the Congress of the Republic of Colombia. It can be said that these legislative and jurisprudential instruments represent a significant step not only in allowing companion animals access to additional spaces, but also in highlighting the importance of effectively including individuals with mental health issues while respecting their right to education, as guaranteed in the Colombian context. There are still ongoing challenges regarding the effective implementation of these provisions, but, undoubtedly, this marks a step towards a better, fairer, and more equitable society.
