Abstract: Since its adoption in Nice in 2000 and until 2020, the Spanish Constitutional Court has issued within the framework of appeals for amparo 28 resolutions in which it has referred to the Charter of Fundamental Rights of the European Union. This paper analyzes all these resolutions to find out how the Charter has been applied and if in this time the Constitutional Court has finally recognized the unique nature of the Charter, which is not a treaty for the international protection of human rights, but the catalog of fundamental rights of the European Union.
