Abstract:

The purpose of this paper is to analyze the effects of the decisions of the Inter-American Court of Human Rights on the legal systems of the South American Countries. To that end, it will be analyzed the thesis of the “conventionality control”, developed by the Interamerican Court. The work will focus on the Brazilian legal system. Although the Brazilian Constitution of 1988 have made important progress regarding the protection of human rights, this type of control is not carried out satisfactorily in Brazil by The Brazilian Supreme Court.
