Las instituciones democráticas a prueba de populismo: Una reflexión sobre las protestas chilenas

Abstract

The social conflicts in Latin America and in the rest of the world remind us of the extent to which legal and institutional forms sacrifice interests and forms of life, producing painful inequalities and conflicts, and reveal-ing once again the paradoxical and ambivalent nature of law, the order of which is profoundly and constitutively embedded in the dimension of power. The Roman concept of fictio legis can perhaps help to visualize this delicate dynamic, in order to avoid a hypostatization of the historically achieved institutional order.

Los conflictos sociales que tienen lugar tanto en América Latina como en el resto del mundo nos recuerdan hasta qué punto las formas jurídico-ins-titucionales sacrifican intereses y formas de vida, produciendo dolorosas desigualdades y conflictos, y revelando una vez más el carácter paradójico y ambivalente del derecho, cuyo orden está profunda y constitutivamente inserto en la dimensión del poder. El concepto romano de fictio legis pue-de quizás ayudar a visualizar esta delicada dinámica, evitando hipostasiar el orden institucional históricamente alcanzado.
