Una lettura eterodossa di Liv. 3.44-48

Abstract

Liv 3.44-48 descrive, con dettagliate affermazioni, la vicenda nota come il processo di Virginia. In esso si affrontano alcuni problemi giuridici di importante rilievo a cominciare da quello relativo alla natura giuridica del processo descritto, lite di libertà per alcuni o conflitto di situazioni potestative per altri. Inoltre, e di conseguenza, occorre chiarire la questione del ‘possesso interinale di Virginia’ e della identificazione del soggetto legittimato a rivestire il ruolo di adsertor in libertatem. Proprio per la complessità delle questioni sollevate, una parte autorevole della moderna romanistica ha finito per svalutare la testimonianza liviana, proponendo differenti conclusioni sulla base di Dion. Hal. 11.29.1-3. Rispetto alle questioni discusse si è inteso proporre una diversa interpretazione motivata non solo sulla corretta decodificazione del testo liviano, ma anche di Tab. 1. 6-9, di Gai 4.16 e della natura popolare dell’intervento dell’adsertor in libertatem, rispetto al quale ritengo che la legittimazione ad agire fosse estesa anche al di fuori della familia e della gens, come comprovato dal fatto che Icilio, cioè il fidanzato di Virginia, assume le vesti di adsertor in libertatem nella fase in iure.

Liv 3.44-48 describes, with detailed statements, the event known as Virginia's process. It deals with some important legal problems, starting with that relating to the legal nature of the process described, a dispute over freedom for some or a conflict of potestative situations for others. Furthermore and consequently, it is necessary to clarify the issue of the 'interim possession of Virginia’ and the identification of the subject legitimated to play the role of adsertor in libertatem. Considering the complexity of the issues raised, an authoritative part of modern Roman studies has devalued Livian testimony, proposing different conclusions on he basis of Dion. Hal. 11.29.1-3. With reference to the issues discussed, it was intended to propose a different interpretation based not only on the correct decoding of Livio's text, but also of Tab. 1. 6-9, of Gai 4.16 and of the ‘popular nature’ of the intervention of the adsertor in libertatem, as to which I believe that the legitimacy to act was also extended outside the familia and the gens, as demonstrated by the fact that Icilio, that is Virginia's fiancé, takes on the role of adsertor in libertatem in the in iure phase.
